New information duties when hiring (RD 723/2026)

Royal Decree 723/2026 (Official Gazette 15 September) requires written information on working conditions before the first day. It replaces RD 1659/1998. It applies from 5 October 2026. It covers contracts longer than 4 weeks.

If the contract already includes everything, no extra paper is needed. If something is missing, a separate document must be handed over. Source: BOE-A-2026-19200.

What must be disclosed

As a minimum: who signs; start date and, if temporary, end date; company address and place of work; the job and, if temporary, the reason; professional category; base salary and each allowance separately; hours, shifts, nights, overtime and holiday; irregular hours and seasonal staff; probation; training; temporary-work agencies; algorithms that assign shifts, tasks or pay; equality, work-life and harassment plans; LGBTI measures if any; notice to end the contract; the applicable collective agreement (code, publication and term); mutual insurer, extra benefits and pension plans; and when conditions may change.

Some items may refer to the collective agreement or the law, if the reference is clear.

Work abroad, changes and delivery

More than 4 weeks outside Spain: country, duration, currency, allowances and whether repatriation is paid. In the EU, also the host-country wage and the official posting website.

Any change is notified in writing, no later than the day it applies. No extra notice is needed if the change is the agreement or the law itself and those were already cited.

Paper or digital. The person must be able to read, keep and print it. The company keeps proof of delivery. Accessible for people with disabilities.

Staff already on payroll: if they ask, 30 working days (if they do not already have it). Changes after 5 October follow the ordinary deadline. Employment will publish a SEPE template; do not wait for it (additional provision 1).
